　　內容提要：依法推進政府職能轉變的提出，是基于以往歷次政府職能轉變主要是依靠權力和關系在體制內封閉進行，缺少法制的剛性約束，導致不斷反復。推動國家治理現代化使破解這一難題有了突破口，即政府職能轉變作為實現國家治理現代化的必然要求，必須納入國家治理法治化軌道，運用法治思維和法治方式，在法律框架內進行，通過建立和完善行政法律規范體系，合理規范權力運行，建設善治意義上的治理服務型法治政府，以更好地體現現代國家治理所內蘊的現代法治精神，加速向現代國家轉型，并在這個過程中不斷依法解決國家治理現代化中的各種問題，更好地體現制度的正義和自信。

　　To promote the transition of government function,put forward in accordance with the law,is based on any past government function transformation mainly rely on the power and the relationships within the system closed,lack of the rigid constraints of the legal system and lead to constant.The modernization of national governance a breakthrough in the problem of crack is put forward,namely the change of government function as to realize the requirement of the modernization of the national governance,the orbit must be included in the national governance,using the rule of law thinking and way of the rule of law,the legal framework,through establishing and perfecting administrative law system,the reasonable standard power operation,the construction of service-oriented government under the rule of law,good governance in the sense of governance in order to better reflect the intrinsic spirit of modem rule of law,modem state governance to accelerate the transformation to modem countries,and constantly in the process in accordance with the law to solve the various problems in modernization of governance,to better reflect the justice system and self-confidence.

　　依法推進政府職能轉變的提出，是基于以往歷次政府職能轉變主要是依靠行政權力在體制內封閉進行，改來改去總是回到原點。盡管依法治國和依法行政也提出好多年，法律體系日臻完備，但由于延續千年的傳統人治影響根深蒂固，司法權威性不足，實際發揮作用的還是行政手段，政府對資源的絕對壟斷反而越來越嚴重，直至固化，束縛著體制外市場和社會功能的發揮。這種做法在推進國家治理現代化階段不僅不能再繼續沿用，甚至還是巨大障礙。黨中央將“全面推進依法治國”視為治理國家的基本方略和“推進國家治理體系和治理能力現代化”的“重要保證”，提出“依法全面履行政府職能”，使政府職能轉變按照依法治理要求被納入法治軌道，真正有了實質性突破的可能。
